These policies explain how MonarchAurex provides website services, handles payments and personal information, manages cancellations and protects both the client and the business throughout a project.

Terms & Conditions
These Terms & Conditions govern the provision of website design, development, digital identity and related services by MonarchAurex.
1. Website Services
MonarchAurex provides website design and development services for individuals, graduates, professionals, businesses and other clients.
Services may include website design, development, responsive layouts, professional profile websites, business websites, landing pages, personal brand websites, portfolio websites, deployment assistance and related digital services.
2. Private Offers and Custom Projects
Some projects may be provided through a private or custom offer rather than a standard package.
The price, scope, features, payment schedule and deliverables for a private offer will be agreed with the client before work begins.
A private offer does not automatically have the same price or scope as MonarchAurex's publicly displayed packages.
3. Project Scope
Work will be based on the package or custom project selected by the client and the information supplied during the request process.
Features or work outside the agreed scope may require an additional quotation or revised agreement.
4. Revisions and Client Approval
Clients are responsible for reviewing website content, information, images and design elements supplied for approval.
Reasonable revisions may be included depending on the selected package or agreed project scope.
Significant changes after approval, additional pages, new functionality or changes to the original project direction may be treated as additional work.
5. Client Responsibilities
The client is responsible for providing accurate and lawful information required to complete the project.
- Providing accurate personal or business information.
- Providing content, images and documents where required.
- Reviewing submitted work within a reasonable period.
- Providing feedback necessary to continue the project.
- Ensuring that supplied content does not violate another person's rights.
6. Intellectual Property
Ownership of final website work will depend on the agreed project terms and whether all required payments have been completed.
MonarchAurex may retain ownership of reusable frameworks, development methods, templates, code components and internal systems used to create websites unless otherwise agreed in writing.
7. Domain, Hosting and Deployment
Domain registration, hosting, third-party services and external subscriptions may involve additional costs unless specifically included in the selected package.
Clients remain responsible for renewal fees associated with domains, hosting or third-party services that are registered or maintained on their behalf.
8. Website Support and Maintenance
Support included in a package is limited to the scope stated for that package or project.
Ongoing maintenance, content updates, new features, redesigns or technical changes may require a separate agreement.
9. Website Availability
MonarchAurex will make reasonable efforts to deliver websites correctly. However, website availability can depend on hosting providers, domain providers, internet connectivity, third-party platforms and other external systems.
MonarchAurex cannot guarantee uninterrupted operation of services controlled by third parties.
10. Limitation of Responsibility
MonarchAurex will take reasonable care when providing its services. However, MonarchAurex is not responsible for losses caused by third-party platforms, hosting providers, domain providers, payment providers, internet outages, client-supplied information or circumstances outside its reasonable control.
11. Governing Law
These policies are intended to operate in accordance with applicable laws of the Republic of South Africa, subject to any mandatory rights or protections that may apply to the client.
Privacy Policy
MonarchAurex respects the privacy of clients and takes reasonable steps to protect personal information collected through its website and services.
1. Information We May Collect
Depending on the service requested, MonarchAurex may collect information such as:
- Name and surname.
- Email address.
- Contact information.
- Professional information.
- Website content.
- Profile photographs or other uploaded files.
- Payment and transaction-related information.
- Information necessary to provide the requested service.
2. How Information Is Used
Personal information may be used to process requests, communicate with clients, build websites, process payments, provide support, maintain records and improve services.
3. Third-Party Service Providers
MonarchAurex may use third-party platforms to provide certain services.
These may include services used for forms, image storage, website hosting, domain services and payment processing.
4. Profile Images and Cloud Storage
Where a client uploads a profile photograph or other image for website development, the image may be processed through a third-party cloud image service.
The image is used for the agreed website project and should not be treated as public unless the client chooses to publish it through their website or otherwise gives permission.
5. Forms and Communication
Information submitted through MonarchAurex forms may be processed through third-party form-processing infrastructure for the purpose of receiving and managing client requests.
6. Payment Information
Payments may be processed through PayFast or another designated third-party payment provider.
MonarchAurex does not require clients to send card numbers, CVV codes or banking passwords directly to MonarchAurex through ordinary website forms.
7. Information Security
MonarchAurex takes reasonable technical and organisational measures to protect personal information against unauthorised access, loss, misuse or disclosure.
No internet-based system can guarantee absolute security, and clients acknowledge the inherent risks associated with transmitting information online.
8. Retention of Information
Personal information may be retained for as long as reasonably necessary for legitimate business, contractual, administrative, legal or accounting purposes.
9. Privacy Requests
Clients may contact MonarchAurex regarding questions about their personal information, subject to applicable legal requirements and verification of identity where necessary.
Important: This privacy policy describes MonarchAurex's intended handling of personal information. It should not be interpreted as a statement that every aspect of the business is automatically compliant with every requirement of applicable privacy legislation.
Refund & Cancellation Policy
This section explains how cancellations and refunds may be handled when a client purchases website services from MonarchAurex.
1. Cancellation Before Work Begins
A client who wishes to cancel a project should contact MonarchAurex as soon as possible.
Where work has not yet started, MonarchAurex may consider the cancellation and any applicable refund in accordance with the agreed project terms and applicable law.
2. Cancellation After Work Begins
If development or other project work has already started, the amount refundable may be affected by work already completed, resources committed and non-refundable third-party costs.
3. Third-Party Costs
Costs already paid to third-party providers may not be recoverable by MonarchAurex.
Examples may include domain registration, hosting, software subscriptions, payment processing fees or other third-party services.
4. Client Delays
A project may be delayed when required information, content, approvals or feedback are not supplied by the client.
Extended delays may affect the project timeline and may require the project to be rescheduled.
5. Refund Requests
Refund requests should be submitted through the official MonarchAurex communication channel and should include sufficient information for the request to be reviewed.
Legal rights: Nothing in this policy is intended to remove or limit consumer rights that cannot lawfully be excluded or limited under applicable South African law.
Payment Policy
This policy explains how payments are handled for MonarchAurex website projects.
1. Standard Package Payments
Standard website packages may require an initial payment before development begins.
Where the 35% Initial Payment option is selected, 35% of the agreed package price is payable initially, with the remaining balance becoming payable according to the agreed project terms.
2. Remaining Balance
The remaining balance must be paid in accordance with the payment arrangement communicated to the client.
Final delivery, deployment, transfer of relevant project materials or other completion steps may be dependent on settlement of the required outstanding balance where this forms part of the agreed terms.
3. Private Offers
Private offers may have a different price and payment arrangement from the publicly displayed packages.
The client will be informed of the agreed amount and payment terms before accepting the private offer.
4. PayFast
MonarchAurex may use PayFast as its third-party online payment service provider to securely process payments.
Payment information may therefore be processed by PayFast in accordance with PayFast's own terms, security procedures and privacy practices.
5. Payment Confirmation
A payment is not considered fully confirmed merely because a client has been redirected back to the MonarchAurex website after attempting payment.
Payment confirmation may depend on successful verification through the relevant payment provider and MonarchAurex's payment system.
6. Failed Payments
If a payment fails, is cancelled, reversed or is not successfully confirmed, the related amount remains outstanding until a successful payment arrangement has been made.
7. Outstanding Balances
MonarchAurex may pause development, delivery, deployment or other project activity where an agreed payment becomes overdue, subject to the applicable agreement and law.
8. Payment Records
MonarchAurex may retain transaction and payment records for accounting, administrative, contractual and legal purposes.
Acceptance
By requesting, purchasing or proceeding with a MonarchAurex service, the client acknowledges that they have had an opportunity to review the applicable policies and agree to the terms that apply to their project, subject to any rights that cannot lawfully be excluded.
Where a separate written agreement, quotation or private offer applies to a project, that agreement may contain additional project-specific terms.
